1. Scope and provider
These Terms and Conditions apply to all contracts concluded via the website The Traveler's Archive (thetravelersarchive.earth) between

(the "Provider") and you as the customer. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
2. Subject of the contract
Through the website, the Provider offers access to the digital content of the archive. This is provided through paid access levels (clearances) by subscription, which unlock content organised by clearance level. Voluntary support contributions (donations) are also possible; a contribution of 5 EUR or more grants a time-limited access of 30 days.
Printed books and ebooks are not sold through this website; they are distributed solely through external retailers (including Amazon/KDP and IngramSpark). The terms of the respective retailer apply to those purchases.
3. Formation of the contract
The presentation of offers on the website is not a legally binding offer but an invitation to order. By submitting your order via the final button, labelled "order with obligation to pay" (in German "zahlungspflichtig bestellen") or a correspondingly clear wording, you make a binding offer. The contract is formed once the Provider confirms it or provides the service. Payment is processed via the payment service Stripe.
4. Prices and payment
The prices shown on the website at the time of the order apply. The Provider is a small business within the meaning of Section 19 of the German VAT Act (Kleinunternehmer); no value added tax is charged or shown separately. Payment is processed via Stripe; the payment methods available there apply.
5. Provision
Access to the paid content is provided after successful payment, as a rule immediately by unlocking access or by sending an access code.
6. Paid access levels and subscriptions
Paid access levels are offered as a recurring subscription and renew according to the chosen billing period until cancelled. Management, changes (upgrade or downgrade), and cancellation are handled through the payment provider's customer portal. A cancellation takes effect at the end of the billing period already paid for; access continues until then and afterwards reverts to the free level. A 30-day access granted from a donation ends automatically after the 30 days have elapsed.
7. Right of withdrawal
Consumers have a statutory right of withdrawal. The details, including the early expiry for digital content and the model withdrawal form, are set out in the Right of Withdrawal notice.
8. Rights of use
The digital content is provided solely for personal, non-commercial use. Passing on, reproduction, making publicly available, or other distribution beyond private use is not permitted without the Provider's consent. Access codes are not intended to be shared.
9. Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body, or health. For simple negligence, the Provider is liable only for breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. Mandatory statutory liability rules, in particular under the German Product Liability Act, remain unaffected.
10. Consumer dispute resolution
The Provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should any provision of these Terms be invalid, the validity of the remaining provisions is unaffected.
